S.B. 3090 Summary

• Establishes the Mauna Kea Management Authority as an independent state agency to manage approximately 11,400 acres on Mauna Kea, replacing existing University of Hawaii management with a board of 7 members representing astronomy, land management, business, environment, and Native Hawaiian cultural expertise.

• Limits telescope presence to no more than 13 on Mauna Kea lands at any time, reducing to 9 telescopes by January 1, 2028, and caps total developed footprint of improvements at December 31, 2031 levels.

• Requires the Authority to transfer 20% of all revenues from Mauna Kea activities (leases, fees, commercial activities, intellectual property) to the Office of Hawaiian Affairs for use in benefiting Native Hawaiians.

• Establishes police powers for Authority rangers to enforce laws on Mauna Kea lands and grants free access to individuals exercising Native Hawaiian traditional and customary practices protected under the state constitution.

• Effective date is December 31, 2033; appropriates funds for startup costs and creates a revolving fund for Authority operations and management of Mauna Kea lands.
