SB 3095 Summary

• Creates a new Pesticide Reporting and Regulation Program requiring all users of restricted use pesticides to submit annual reports to the Department of Agriculture beginning January 1, 2019, with reports due within 30 days of each calendar year end.

• Establishes a 100-foot buffer zone around school properties prohibiting restricted use pesticide applications during normal school hours (Monday-Friday, 7:00 a.m. to 4:00 p.m.) beginning January 1, 2019, with exemptions for whole structure fumigation.

• Prohibits use of pesticides containing chlorpyrifos as an active ingredient beginning January 1, 2019, but allows temporary permits valid through December 31, 2022, upon request.

• Modifies the pesticide use revolving fund to include all penalties and fines collected under Hawaii's pesticide law and increases the fund ceiling from $250,000 to $1,000,000.

• Appropriates $705,648 total for fiscal year 2018-2019 for pesticide drift monitoring study, two new full-time positions in the Department of Agriculture, and outreach and education activities.
