HI SB429

Establishes the Uniform Employee and Student Online Privacy Protection Act, prohibiting employers from requiring or coercing employees to disclose login information or content of protected personal online accounts.

Prevents employers from taking adverse action against employees who refuse to disclose account credentials, alter account settings, or allow employer observation of login information or account content.

Applies the same protections to students and educational institutions, prohibiting schools from requiring disclosure of login information or content of protected personal online accounts.

Permits employers and educational institutions to access account content (but not login credentials) based on specific facts when necessary to ensure legal compliance, investigate misconduct, protect safety, or protect against threats to technology systems or proprietary information.

Allows the Attorney General and individuals to bring civil actions for violations, with civil penalties up to $1,000 per violation (capped at $100,000) and employees/students able to recover injunctive relief, actual damages, costs, and attorney's fees; effective July 1, 2050.
