Authorizes the Board of Land and Natural Resources to issue a 55-year term, non-exclusive easement for approximately 2,920 square feet of state submerged lands at Honokawai, Lahaina, Maui, for seawall maintenance, repair, and removal.

Easement covers state-owned land fronting Tax Map Key (2) 4-4-001:042, associated with the Hale Kai Condominium complex, with an original seawall constructed in 1965.

BLNR previously approved the easement in August 2011 and subsequently approved amendments in June 2014, November 2014, and October 2016 to account for shoreline migration.

The Association of Unit Owners of Hale Kai Condominium must pay fair market value as determined by an independent appraiser for use of the public lands.

Required by Hawaii Revised Statutes section 171-53, which mandates prior gubernatorial approval and legislative authorization by concurrent resolution for leasing state submerged lands.
