Authorizes the Board of Land and Natural Resources to issue a 55-year term, non-exclusive easement to Seaview 2004, Inc. for state submerged lands at Spreckelsville, Wailuku, Maui (Tax Map Key (2) 3-8-002:seaward of 001).

Covers approximately 1,128 square feet of land containing an existing seawall, concrete rubble masonry wall, steps, and boulder revetment that have encroached on state lands for over 90 years.

Grantee must pay fair market value for the easement as determined by an independent appraiser and previously paid a $500 fine for illegal encroachment (approved by Board of Land and Natural Resources on September 22, 2017).

Removal of the encroachment was determined to be impractical and unnecessary, as the structures provide public safety benefits, storm protection, and have not impeded public beach access during their 90+ year presence.

Requires prior legislative authorization under Hawaii Revised Statutes section 171-53 for leasing state submerged lands.
