HB 1171 Summary

• Extends water permit holdovers from a maximum of 3 consecutive years to 10 consecutive years under Hawaii Revised Statutes section 171-58(c).

• Requires holdovers authorizing over 2 million gallons per day to include conditions minimizing impacts to public trust purposes and limit aggregate surface water to demonstrated actual, reasonable, beneficial needs.

• Mandates holdovers continue without Board action while contested case proceedings under chapter 91 are pending.

• Exempts traditional production of wetland kalo from chapter 171 water rights disposition provisions.

• Requires Board of Land and Natural Resources to retain a certified appraiser to determine water valuation and hold public hearings on proposed administrative rules for water disposition and valuation before approving holdovers after January 1, 2020.
