HB 1246 Summary

• Amends Section 708-814, Hawaii Revised Statutes, to streamline evidence requirements for criminal trespass in the second degree charges on commercial premises.

• Allows evidence of a prior written warning or request to leave to be shown by a copy of the warning, whether or not the copy is posted at the premises or retained by the county police department.

• Maintains the one-year validity period for written warnings and specifies required warning contents including the person's legal name, photograph or physical description, name of person giving warning, date, time, and signatures.

• Clarifies that the same "reasonable warning or request" standard applies to housing projects and other property types under the criminal trespass statute.

• Takes effect on January 28, 2081.
