HB 253 Summary

• Prohibits persons from intentionally or knowingly manufacturing, importing, installing, reinstalling, distributing, selling, or offering for sale counterfeit supplemental restraint system components, nonfunctional airbags, or airbags that do not meet federal safety requirements (49 CFR 571.208) with intent to replace functional airbags in motor vehicles.

• Prohibits persons from intentionally or knowingly selling, offering for sale, installing, or reinstalling devices that cause a motor vehicle's diagnostic systems to fail to warn that the vehicle is equipped with counterfeit or nonfunctional airbags or lacks an airbag entirely.

• Defines "nonfunctional airbag" to include previously deployed or damaged airbags, airbags with electrical faults detected by diagnostic systems, airbags containing misleading parts or objects, and airbags prohibited under 49 USC 30120(j).

• Violation of this section constitutes a class C felony.

• Effective date: July 1, 2050.
