HB 306 Summary

• Requires owners of agricultural or preservation land subdivided as condominium property regimes to provide public notice of sale within 90 days in counties with population of 750,000 or more.

• Prohibits any residential use of structures on subdivided agricultural and preservation lands in counties with population of 750,000 or more, with violations subject to county enforcement and fines.

• Allows counties with population of 750,000 or more to adopt ordinances and rules governing condominium property regimes and to consider infrastructure, environmental impacts, and other requirements when reviewing condominium applications on agricultural land.

• Permits community members to report suspected violations of agricultural land subdivision requirements to county enforcement authorities, which must investigate within 30 days and report findings to the state Department of Agriculture annually.

• Takes effect June 29, 2019.
