H.B. 354 Summary

• Amends Section 200-10, Hawaii Revised Statutes, to require moorage fees for non-commercial mooring use permits at state small boat harbors be determined by appraisal by a state-licensed appraiser and set at fair market value.

• Replaces previous tiered schedule system (Schedule A for existing permittees and Schedule B for new applicants) with a single fair market value appraisal method that may be updated no more than once per twelve months.

• Changes liveaboard fees (charged when a recreational vessel is used as principal habitation) from fixed per-foot rates ($5.20/foot for residents, $7.80/foot for nonresidents) to appraisal-based fair market value fees set once per year.

• Requires any moorage fee increases to take effect sixty days after department approval, creating a mandatory notice period for permittees.

• Takes effect August 1, 2019.
