Full-service restaurants are prohibited from providing single-use plastic straws to consumers unless explicitly requested by the consumer.

First and second violations result in a notice of violation issued by the director; subsequent violations incur a $25 per day fine not to exceed $300 per calendar year.

"Full-service restaurant" is defined as an establishment where employees seat customers, take orders after seating, deliver food and beverages directly to consumers, and deliver checks at the assigned eating area.

"Single-use plastic straw" means a disposable tube made from petroleum-derived or biologically-based polymers used to transfer liquids, excluding straws made from paper, pasta, wood, or bamboo.

The Act takes effect on July 1, 2100.
