HB 863 Summary

• Requires physicians and surgeons who conduct employer-paid medical examinations of workers' compensation claimants to be appropriately licensed in Hawaii under chapter 453

• Mandates that examining physicians/surgeons possess medical malpractice insurance and owe the same duty and standard of care to injured employees as they would owe to traditional patients

• Makes permanent an injured employee's right to record medical examinations with the examining physician's or surgeon's approval

• Limits employer-requested examinations to one per case unless good and valid medical reasons exist regarding the employee's treatment progress

• Caps the cost of employer-ordered medical examinations to complex consultation charges under the medical fee schedule established by section 386-21(c)
