• Requires all new places of public accommodation and state building construction completed or substantially modified after December 31, 2020 to provide baby diaper-changing accommodations equally accessible to men and women.

• New establishments must provide either two separate diaper-changing accommodations (one in women's and one in men's restrooms) or one accessible to both, on each floor with public restrooms.

• Defines "substantially modified" as reconstruction affecting more than 50% of gross floor area, costing at least $50,000, or restroom renovation costing at least $10,000; does not apply if no structural restroom changes are made.

• Allows hardship exemption if no reasonable physical option exists or compliance costs exceed 10% of total construction/modification cost.

• Violations constitute unlawful discriminatory practices enforceable through private civil action in district court with available damages including $100 statutory award, attorneys' fees, and court costs; excludes enforcement by Hawaii Civil Rights Commission.
