HB 931 Summary

• Prohibits landlords from evicting tenants or recovering possession of a dwelling unit when the landlord's failure to maintain habitability has significantly impaired the premises

• Requires tenants to continue paying rent equal to the fair rental value or agreed rent (whichever is less) during periods of significant habitability impairment

• Limits tenant rent liability to the fair rental value of the premises from the date habitability becomes significantly impaired

• Establishes that a landlord's right to recover possession is restored only upon lease termination or restoration of the premises to habitable condition, whichever comes first

• Increases damages for unlawful retaliatory evictions to two months rent plus court costs and reasonable attorney's fees
