Establishes that all overpayments of retirement and refund benefits constitute a debt due and owing to the Employees' Retirement System (ERS) by the recipients.

Authorizes the ERS to adopt and enforce rules necessary to recover overpaid benefits, including procedures for civil court action, filing liens against real property, and filing claims against estates of deceased recipients.

Permits the board of trustees or executive director to waive recovery of overpayments in cases of bona fide hardship or where recovery costs would exceed the amount expected to be recovered.

Changes Section 88-106 to require the board of trustees to recover overpayments resulting from calculation or record errors, unless recovery is waived under Section 88-6 procedures.

Takes effect upon approval.
