HI SB1035

Repeals the civil statute of limitations for child sexual abuse, allowing survivors to bring actions for damages at any time regardless of when the abuse occurred.

Previously limited civil actions to eight years after the victim's eighteenth birthday or three years after discovering psychological injury caused by the abuse, whichever came later; this bill removes those time restrictions.

Permits claims against both individual perpetrators and legal entities (institutions, agencies, businesses, corporations) that employed the abuser or had responsibility or control over activities where abuse occurred.

Requires a finding of gross negligence to award damages against legal entities.

Takes effect July 1, 2019.
