SB 1042 Summary

• Amends Act 110 (Session Laws of Hawaii 2018) by extending the deadline for the Legislative Reference Bureau to complete a study on Title IX enforcement practices and procedures from "twenty days prior to the 2019 regular session" to March 1, 2019.

• Requires the Legislative Reference Bureau to examine enforcement entities, complaint procedures, available remedies (alternative dispute resolution, injunctive relief, civil damages), and inconsistencies between state and federal compliance mandates related to sex discrimination in education.

• Directs the Legislative Reference Bureau to submit findings, recommendations, and proposed legislation regarding an appropriate enforcement mechanism for Hawaii's state-level sex discrimination law (chapter 368D, Hawaii Revised Statutes).

• Takes effect upon approval.
