SB1077 Summary

• Director of Public Safety must report to the Governor within 48 hours of any death of a Hawaii inmate in state or contracted correctional facilities, or death of a correctional facility employee who dies on facility grounds or from injury sustained there

• Death reports must include decedent's name, age, gender, status (inmate or employee), location, date and time, cause of death, any indication of sexual assault, and clinical mortality review results if available

• Official cause of death must be reported immediately to the Governor and Legislature once determined

• Director may withhold decedent's name or information protected by state or federal law

• Department must preserve human biological specimens for criminal investigation if there is any indication of sexual assault leading to death of an inmate or employee

• Existing requirement for department to address sexual assault in prison and report annual data to legislature is maintained

• Effective date: July 1, 2050
