S.B. 1135 Summary

• Authorizes the Land Use Commission to amend, revise, or modify a previous decision and order granting a district boundary amendment if a petitioner or their successors fail to adhere to representations or imposed conditions, regardless of whether substantial commencement of land use has occurred.

• Allows the Commission to issue an order to show cause why property should not revert to its former land use classification or be changed to a more appropriate classification based on non-compliance with conditions.

• Empowers the Commission to assess administrative fines up to $50,000 per day plus enforcement costs if representations or conditions relating to infrastructure, environment, cultural resources, archaeological resources, or public trust doctrine are not adhered to.

• Defines "substantial commencement" as completion of all required public improvements and infrastructure, and construction of at least 20 percent of any affordable housing requirement to be usable or habitable.

• Effective January 1, 2020.
