Prohibits scuba spearfishing at night in state marine waters for taking aquatic life, except with a permit issued by the department.

Allows the department to issue permits for nighttime scuba spearfishing and to revoke permits for violations of permit terms and conditions.

Persons whose permits are revoked become ineligible to apply for another permit for one year from the revocation date.

Requires the department to adopt rules under chapter 91 for enforcement and exemptions to the prohibition.

Takes effect on December 31, 2050.
