• Requires past performance to be evaluated in all competitive sealed bids and proposals expected to meet or exceed the small purchase threshold, as well as in sole source contract awards.

• Mandates procurement officers determine offeror responsibility by considering financial ability, satisfactory past performance, resources, skills, capability, and business integrity.

• Requires written past performance evaluations for all procurements over the small purchase threshold to be conducted at least annually and upon work completion, with evaluations maintained in departmental procurement files and a statewide past performance database.

• Establishes an initial procurement working group composed of state and county procurement representatives to identify procurement issues, document existing practices, identify gaps in laws and rules, and recommend objective criteria for evaluating contractor past performance by November 1, 2020.

• Appropriates general revenues for fiscal years 2019-2020 and 2020-2021 to develop a statewide past performance database and fund outsourced positions for rule development and benchmarking analysis.
