SB 25 Summary

• Establishes trade name registration requirements for insurance licensees with the Department of Commerce and Consumer Affairs prior to use or change of trade names in Hawaii (effective October 1, 2019).

• Requires limited benefit health insurance policies to include conspicuous disclaimer in at least 14-point boldface type stating the coverage does not satisfy the Affordable Care Act's minimum essential coverage requirement.

• Mandates health care providers performing covered services be eligible for reimbursement under insurance policies, contracts, plans, or agreements to the same extent as other eligible providers acting within their licensed scope of practice.

• Updates Hawaii Insurance Code provisions including valuation standards for life insurance, investment pool regulations, rate filing procedures, managed care plan filing requirements, and health carrier network adequacy standards (with temporary provisions through July 1, 2024).

• Repeals section 431:10A-102.5 regarding limited benefit health insurance definitions and consolidates those provisions into new section 431:10A-C.
