HI SB641

Creates new offense of operating a vehicle while impaired by a lesser intoxicant, defined as any plant, medication, chemical, or compound (including central nervous system depressants, stimulants, hallucinogens, dissociative anesthetics, narcotic analgesics, or inhalants) excluding alcohol and scheduled drugs under chapter 329.

Penalties for the offense are a fine not to exceed $1,000 and/or imprisonment not to exceed 30 days, classified as a petty misdemeanor.

Requires law enforcement agencies to annually collect and report to the legislature data on investigations, arrests, blood/urine test results, and types of lesser intoxicants detected.

Requires the Criminal Justice Data Center to annually collect and report convictions for operating a vehicle while impaired by a lesser intoxicant.

Effective July 1, 2050, with automatic repeal on June 30, 2022 (note: effective date is after repeal date).
