SB 734 Summary

• Amends Section 576D-14 of Hawaii Revised Statutes to add new subsection (c) requiring the child support agency or family court to enter an order requiring an obligor's employer to classify the obligor as an employee for payroll purposes when the obligor is delinquent by three or more months of support payments and upon receiving a request for income withholding from the obligee.

• Applies only to obligors who receive income on a periodic basis and have become delinquent in support payments under Chapter 576 (child support) or Chapter 580 (family court proceedings).

• Renumbers existing subsections (c) through (k) to subsections (d) through (l) to accommodate the new provision.

• Takes effect upon approval with no retroactive application to rights, duties, penalties, or proceedings that occurred before the effective date.
