S.B. 898 Summary

• Requires registered land owners seeking voluntary deregistration to submit a map and description prepared by a licensed professional surveyor to the assistant registrar, in addition to proof of title insurance and a waiver of claims against the State.

• Exempts deregistration of condominiums (chapter 514B), timeshare plans (chapter 514E), planned communities (chapter 421J), and undivided interests in registered land from the surveyor map and description requirement.

• Mandates the assistant registrar refer submitted maps and descriptions to the state land surveyor in the Department of Accounting and General Services for approval as to form and mathematical correctness before recording in the Bureau of Conveyances.

• Requires the assistant registrar to record the certificate of title, deregistration request, and approved surveyor's plan in the Bureau of Conveyances, then cancel the land court certificate and notify the land court registrar and state land surveyor.

• Amends section 502-17 to establish data requirements for filed plans, including the surveyor's map and description of deregistered parcels and associated certificate of title document numbers.
