S.B. 975 Summary

• Requires owners of parcels subdivided as condominium property regimes on agricultural or preservation lands in counties with 750,000+ population to provide public notice of sale no later than 90 days after the sale.

• Prohibits any residential use of structures (including sheds and temporary buildings) on subdivided agricultural and preservation land for any length of time, with violations subject to county enforcement and fines.

• Prohibits residential development on lands in preservation zoning districts in counties with 750,000+ population.

• Allows counties with 750,000+ population to consider infrastructure availability, environmental resource impacts, and other county requirements when reviewing condominium project applications on agricultural land.

• Requires condominium project public reports to declare compliance with section 205-4.5(f) regarding agricultural use restrictions and allows community members to report suspected violations to county enforcement authorities.
