S.C.R. NO. 183 Summary

• Authorizes the Board of Land and Natural Resources to grant seven term easements (Easements 1-7) for 65 years over state submerged lands at Waiohuli-Keokea (Kihei), Wailuku, Maui for use, maintenance, and repair of an existing seawall.

• Separates the original seawall easement (approved in 2016 for 65 years beginning August 10, 1990) into two separate easements held by individual unit owners of the 1688 Halama Street Condominium instead of the Association.

• Grants three easements (1, 2, 3) totaling 682 square feet to Unit B and four easements (4, 5, 6, 7) totaling 696 square feet to Unit A of the condominium.

• Requires fair market value compensation as determined by independent appraisal to be paid by the easement holders.

• Requires Board of Land and Natural Resources approval under Hawaii Revised Statutes section 171-53, which mandates prior legislative authorization to lease state submerged lands.
