S.C.R. No. 70 Summary

• Requests the Office of Hawaiian Affairs to conduct an independent fiscal audit of all limited liability corporations (LLCs) created or controlled by the Office.

• The Office of Hawaiian Affairs has used LLCs to distribute Native Hawaiian Trust Fund monies to recipients who would not have otherwise met the Office's requirements.

• The 2018 audit of the Office of Hawaiian Affairs did not include LLCs in its scope and raised concerns regarding spending irregularities and possible breaches of fiduciary duties.

• The Office of Hawaiian Affairs must report the audit findings and recommendations to the Legislature no later than twenty days before the Regular Session of 2020.

• Certified copies of the resolution shall be transmitted to the Chairperson and Chief Executive Officer of the Office of Hawaiian Affairs and the State Auditor.
