S.C.R. No. 9 Summary

• Requests the Department of Human Services, in consultation with the Hawai'i Civil Rights Commission and the Disability and Communication Access Board, to examine and report on the implementation of Act 217 (2018), which established civil penalties for knowingly misrepresenting animals as service animals.

• Department must examine four specific areas: enforcement methods for the misrepresentation prohibition, whether administrative rules are needed, oversight and regulation of service animals, and whether additional legislation is necessary.

• Department is requested to issue guidance about service animal misrepresentation for use by law enforcement and the business community.

• Department is requested to develop a public outreach campaign to educate places of accommodation and the general public about the important work of legitimate service animals.

• Department must submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days prior to the 2020 regular session convening.
