• Authorizes the Board of Land and Natural Resources to amend a 55-year term, non-exclusive easement for state submerged lands seaward of Spreckelsville, Wailuku, Maui (Tax Map Key (2) 3-8-002:seaward of 001).

• Increases the easement area from 1,128 square feet to 2,206 square feet to cover an existing seawall, boulder revetment, and concrete rubble masonry structures for use, repair, and maintenance.

• Requires grantee Seaview 2004, Inc., to pay fair market value for the easement as determined by independent appraisal; a $500 fine was previously imposed for illegal encroachment in September 2017.

• Finds that the 90-year-old encroachment has not impeded public access, provides storm protection and safe coastal access, and removal would be impossible and unnecessary.

• Provides legislative authorization required under Hawaii Revised Statutes section 171-53 for leasing state submerged lands.
