HB1031 Summary

• Amends Section 200-10, Hawaii Revised Statutes to require moorage fees, liveaboard fees, and certain other fees for state small boat harbors be established by appraisal by a state-licensed appraiser approved by the Department of Land and Natural Resources.

• Removes the previous fee structure that distinguished between resident and nonresident rates and the Schedule A/Schedule B tiered system with automatic increases scheduled through July 1, 2014.

• Requires all fees established by appraisal be set at fair market value.

• Clarifies that commercial vessel fees shall be calculated as the greater of three percent of gross revenues or the liveaboard fee plus two times the moorage fee (if used as principal habitation) or two times the moorage fee (if not used as principal habitation).

• Takes effect upon approval and does not affect rights, duties, penalties, or proceedings that occurred before the effective date.
