• Requires past performance evaluations to be considered in all sole source contracts and competitive sealed bid or proposal contracts exceeding the small purchase threshold

• Amends Hawaii Revised Statutes sections 103D-302, 103D-303, 103D-306, and 103D-310 to incorporate past performance as a factor in procurement officer responsibility determinations

• Establishes an initial procurement working group composed of state and county procurement representatives to identify procurement issues, document existing practices, and recommend objective criteria for evaluating contractor past performance by November 1, 2020

• Appropriates $250,000 for fiscal years 2019-2020 and 2020-2021: $50,000 to develop a statewide past performance database and $200,000 for two full-time equivalent positions to develop rules and conduct benchmarking analysis

• Effective date is January 1, 2050
