HB 1264 Summary

• Authorizes courts to decree civil penalties for forfeiture of Employees' Retirement System (ERS) benefits when members, former members, or retirants are convicted of felonies related to their state or county employment.

• Permits forfeiture of interest, hypothetical account balances (exceeding employee contributions), pensions, annuities, and retirement allowances upon felony conviction.

• Defines employment-related felonies to include: use of official position to commit felonies, crimes involving state/county time or equipment, bribery, embezzlement or theft of public property, and felonies against persons in custody or supervision.

• Allows designated beneficiaries to receive benefits upon the member's death unless the beneficiary was also convicted of a felony based on the same circumstances.

• Takes effect January 1, 2050 and does not apply to felonies committed before the effective date or to non-forfeitable accrued retirement benefits under existing law.
