HB 1512 Summary

• Prohibits county liquor commissions from adopting or enforcing rules that regulate obscenity, offensive behavior, nudity, lap dancing, striptease, sexual intercourse, simulations of sexual acts, consensual physical contact between adults, or related conduct, unless the rule prevents noise pollution or public viewing of such activities.

• Voids any existing liquor commission rules that violate these restrictions on regulatory authority.

• Requires liquor commissions to issue certificates of registration for dancer employees with the same validity period as certificates issued for other employees of a liquor licensee.

• Amends Hawaii Revised Statutes section 712-1200 to exclude lap dancing performed by a registered dancer on authorized liquor licensee premises from the criminal offense of prostitution.

• Takes effect July 1, 2019.
