• Establishes a new chapter in Hawaii Revised Statutes to authorize and regulate peer-to-peer car-sharing programs, defining key terms including shared cars, shared car drivers, car-sharing periods, and peer-to-peer car-sharing platforms.

• Requires peer-to-peer car-sharing programs to maintain motor vehicle insurance coverage for shared car owners and drivers at minimum amounts required under section 431:10C-301, with the program providing primary insurance coverage, and prohibits participation by owners or drivers whose policies exclude peer-to-peer sharing.

• Mandates peer-to-peer car-sharing programs to disclose all terms, conditions, costs, fees, insurance coverage details, indemnification rights, and safety information to participants prior to execution of agreements, with specific acknowledgment requirements.

• Imposes operational requirements on peer-to-peer car-sharing programs including driver's license verification, six-year record retention, safety recall verification and notification, equipment responsibility and indemnification, damage assessment limits, and airport agreement compliance.

• Amends Chapter 251 to require rental motor vehicle marketplace facilitators to be subject to surcharge tax and establishes notice and reporting requirements for other entities providing rental vehicle forums.

• Effective date: July 1, 2050.
