HB 1904 Summary

• Establishes the Uniform Employee and Student Online Privacy Protection Act to protect online accounts of employees, prospective employees, unpaid interns, applicants, students, and prospective students from employers and educational institutions.

• Prohibits employers and educational institutions from requiring or coercing disclosure of login information, account content, or altered account settings for protected personal online accounts (social media, email, etc.).

• Allows employers and educational institutions to access account content without login information in limited circumstances: complying with law/court orders, investigating work/education-related misconduct, or protecting against safety threats or proprietary information disclosure.

• Provides civil remedies including injunctive relief, civil penalties up to $1,000 per violation (capped at $100,000 per event) for violations by the attorney general, and actual damages plus attorney's fees for employee/student lawsuits.

• Takes effect January 1, 2050.
