H.B. 1967 Summary

• Expands self-protection rights by allowing use of force to defend oneself, another person, or a legally occupied habitation or motor vehicle against unlawful force.

• Eliminates duty to retreat if the person is in a place where they have a right to be (including place of business) and is not engaged in unlawful activity.

• Broadens justification for deadly force to include defense of property and third persons, replacing previous language limited to protection against death, serious bodily injury, kidnapping, rape, or forcible sodomy.

• Provides immunity from criminal prosecution and civil action for persons using justified force, unless the force is determined to be unlawful.

• Takes effect upon approval.
