H.B. 2118 Summary

• Expands standing to bring antitrust enforcement actions to include corporation counsel and county attorneys representing counties, in addition to the attorney general and director of consumer protection.

• Allows corporation counsel or county attorney to bring civil actions to recover treble damages for antitrust violations on behalf of counties under Section 480-14.

• Permits corporation counsel or county attorney to bring class actions on behalf of consumers for unfair or deceptive practices under Section 480-2 and to seek injunctive relief for violations.

• Grants corporation counsel or county attorney concurrent jurisdiction with the attorney general to enforce civil provisions regarding unfair or deceptive acts or practices under Section 480-2.

• Makes judgment or decrees from prior civil or criminal proceedings brought by counties prima facie evidence in subsequent actions under Hawaii's antitrust laws.
