HB23 Summary

• Requires disaster preparedness plans to accompany declarations for all new condominium property regimes submitted for recordation after December 31, 2019

• Requires managing agents of condominium properties created before January 1, 2020, to prepare disaster preparedness plans before January 1, 2020

• Disaster preparedness plans must include safe exit procedures for all persons including those with impaired mobility or special medical needs, alternative shelter options, food provisions for extended displacement, and procedures tailored to different disaster types

• Grants immunity from liability to managing agents who prepare disaster preparedness plans, except in cases of gross negligence or intentional wrongdoing

• Adds disaster preparedness plans to the list of condominium documents that managing agents must keep on file alongside declarations, bylaws, house rules, and other official records
