HB2378 Summary

• Requires each county to establish an expedited procedure for demolition permits of vacant and abandoned residential structures, with processing time to be specified by the legislature.

• Defines "vacant and abandoned" residential structures as one- or two-family unattached buildings on residentially-zoned parcels that have been unoccupied for a specified minimum number of days, with exceptions for properties under construction, seasonal use, probate/title disputes, natural disaster damage, or occupied by mortgagors, relatives, or lawful tenants.

• Allows the Department of Taxation to conduct nonjudicial foreclosure of state tax liens on vacant and abandoned residential properties at any time after establishing the property's vacant and abandoned status through multiple inspections and certified notice to the owner.

• Denies new construction, rehabilitation, or reconstruction building permit applications submitted within a specified timeframe after approval of an expedited demolition permit for the same parcel by the same owner, subject to appeals through the county planning department.

• Takes effect on July 1, 2050.
