HB 2384 Summary

• Amends Hawaii Revised Statutes Section 508D-15 to require sellers of residential real property to disclose if the property lies within the sea level rise exposure area as officially designated by the Hawaii Climate Change Mitigation and Adaptation Commission.

• Adds sea level rise exposure area as a fifth category of hazard area requiring mandatory seller disclosure, alongside existing requirements for flood hazard areas, airport noise exposure areas, military airport compatible use zones, and tsunami inundation areas.

• Requires each county to provide maps identifying properties within the sea level rise exposure area by tax map key (zone, section, parcel) and permits counties to charge reasonable copying fees for map provision.

• Classifies sea level rise exposure area disclosure as a material fact under Hawaii law, recognizing that properties within such areas will have their value measurably affected over time.

• Effective January 1, 2021.
