Clarifies that section 368-1.5, HRS grants the Hawaii Civil Rights Commission jurisdiction over disability discrimination claims under programs or activities receiving state financial assistance, even when federal Rehabilitation Act protections are also available.

Excludes cases within the scope of the Individuals with Disabilities Education Act (P.L. 101-476) from the Hawaii Civil Rights Commission's jurisdiction to avoid duplication with existing federal education appeals processes.

Defines "program or activity receiving state financial assistance" to include programs receiving both federal and state financial assistance, and clarifies that "state financial assistance" means grants, purchase-of-service contracts, or other arrangements providing funds for services rendered on behalf of the State.

Updates terminology in section 368-1.5 to change "solely" to remove the word, and modernizes language from "his or her" to "the individual's" and "which" to "that."

Takes effect upon approval.
