Clarifies that renewed agricultural restrictions on agricultural lands recorded after July 8, 2003 are considered new private agreements and are therefore voidable under Hawaii Revised Statutes Section 205-4.6(a).

Addresses homeowners' associations circumventing existing law by renewing pre-July 8, 2003 agricultural restrictions and claiming they remain exempt from restrictions on limiting agricultural activities.

Maintains exceptions for restrictions protecting environmental or cultural resources, agricultural leases, utility easements, and access easements.

Aligns with Article XI, Section 3 of the Hawaii State Constitution mandating the state conserve and protect agricultural lands and promote diversified agriculture.

Takes effect upon approval with no specified effective date other than passage.
