Amends Hawaii Revised Statutes Section 46-6.5 to establish two options for counties when public access land is dedicated by subdividers or developers: either accept the dedication and maintain it, or require the subdivider to establish and maintain the access through a planned community association.

Authorizes counties to require subdividers or developers to establish and initially fund a stewardship fund controlled by the county for improvement and future maintenance of the right-of-way as a condition of the county accepting the dedication.

Eliminates language that automatically relieved subdividers of improvement and maintenance costs once land was accepted by the county.

Becomes effective on January 1, 2021.

Does not affect rights, duties, penalties, or proceedings that occurred before the effective date.
