HB 295 Summary

• Amends Hawaii's insurance laws (sections 431:10-217.5, 432:1-101.6, 432:2-103.5, and 432D-27) and domestic abuse protective order statutes (section 586-1) to include emotional abuse as a form of domestic abuse between family or household members.

• Defines "emotional abuse" as coercive behavior or controlling behavior continuously or repeatedly directed at an individual with intent to exert power, control, or coercion, excluding legitimate parental discipline.

• Defines "coercive behavior" as continuing acts of assault, threats, humiliation, intimidation, or other abuse used to harm, punish, or frighten a person.

• Defines "controlling behavior" as acts designed to make a person subordinate or dependent by isolating them from support sources, exploiting their resources, or depriving them of means needed for independence and escape.

• Takes effect July 1, 2050.
