H.B. 354 Summary

• Requires moorage fees for all non-commercial mooring use permits at state small boat harbors to be set at fair market value as determined by appraisal by a state-licensed appraiser, with rates reviewed no more than once per twelve months.

• Eliminates the previous tiered fee structure (Schedule A for existing permittees and Schedule B for new applicants) that had different rates for residents and nonresidents.

• Maintains application fees of no less than $100 for nonresidents and authorizes the department to set application fees for residents.

• Requires liveaboard fees for vessels used as principal habitation to be established by appraisal at fair market value, reviewed once per year, replacing the previous fixed rate calculation.

• Establishes a sixty-day implementation period after department approval for all fee increases to take effect; effective August 1, 2019.
