H.B. 389 Summary

• Amends Section 386-79, Hawaii Revised Statutes, to require persons performing independent medical examinations or permanent impairment rating examinations to examine the employee within a specified calendar period of receiving notice of selection or appointment.

• Requires that employees receive a copy of the independent medical examination or permanent impairment rating examination report no later than a specified number of calendar days after the examination date.

• Allows employees to record examinations using a recording device at the employee's expense, provided the examining physician or surgeon approves.

• Extends Act 172, Session Laws of Hawaii 2017, by removing the June 30, 2019 sunset provision, making the amendments permanent.

• Takes effect January 1, 2050.
