Director of corrections may transfer committed felons to out-of-state correctional institutions regardless of compact membership, provided institutions meet health and safety codes and are operated by states, subdivisions, or private entities.

Beginning July 1, 2019, the director must commence reducing the number of committed felons incarcerated in private, for-profit correctional institutions.

Beginning January 1, 2035, no inmate shall be committed or transferred to any for-profit correctional institution.

Any agreement negotiated with a for-profit correctional institution for imprisonment of inmates after December 31, 2034, shall be invalid.

All out-of-state correctional facility agreements must be subject to legislative approval by concurrent resolution.
