HB 582 Summary

• Requires adult day care centers to be licensed or certified by the Department of Health and expands unannounced inspection authority to include these centers and annual relicensing inspections.

• Establishes a caregiver and case manager compensation task force to develop recommendations addressing facility compensation based on bed availability and insurance reimbursement late fee issues, with report due by 2020.

• Expands Department of Health inspection reporting requirements to post all inspection reports (including unannounced and annual inspections) on its website within five working days and remove violation reports after three years.

• Amends licensing and operating standards for community care foster family homes and other licensed facilities, including requirements for primary and substitute caregiver qualifications and continuing education.

• Takes effect July 1, 2050, with sections 2 and 3 taking effect June 30, 2050; supersedes conflicting provisions from Act 184 (Session Laws of Hawaii 2016).
