Establishes time limits for the Director of Human Services to recover Medicaid overpayments made to providers and public assistance overpayments made to recipients (specific number of years to be determined).

Medicaid overpayments subject to recovery include those due to provider ineligibility, noncovered services or drugs, lack of prior authorization, incorrect payment allowances from post-payment reviews, and claims processing errors.

Recovery methods for Medicaid overpayments include recoupment, tax offset, and circuit court judgment.

Director may waive recovery of public assistance overpayments in cases of bona fide hardship or where recovery costs would exceed the amount expected to be recovered.

Changes terminology from "promulgate" to "adopt" regarding departmental rules and regulations for overpayment recovery procedures.
